House Conference Report 109-702

SEC. 831. ONE-YEAR EXTENSION OF SPECIAL TEMPORARY CONTRACT CLOSEOUT AUTHORITY.

Section 804(d) of the National Defense Authorization Act for Fiscal Year 2004 (Public Law 108-136; 117 Stat. 1542) is amended by striking `September 30, 2006' and inserting `September 30, 2007'.

One-year extension of special temporary contract closeout authority (sec. 831)

The House bill contained a provision (sec. 821) that would extend by 1 year authority under section 804 of the National Defense Authorization Act for Fiscal Year 2004 (Public Law 108–136) to allow the Department of Defense to settle contracts entered into prior to October 1, 1996, under specified conditions.

The Senate amendment contained an identical provision (sec. 872).

The conference agreement includes this provision.

SECTION 821--EXTENSION OF SPECIAL TEMPORARY CONTRACT CLOSEOUT AUTHORITY

This section would allow the Department of Defense to maximize its efforts to close contracts by extending the authority. Section 804 of the National Defense Authorization Act for Fiscal Year 2004 (Public Law 108-136) as amended, permits the Department to close contracts entered prior to October 1, 1996, provided the contracts are administratively complete and the financial account has an unreconciled balance, either positive or negative, that is less than $0.1 million.

Senate Armed Services Committee Report 109-254

One-year extension of special temporary contract closeout authority (sec. 872)

The committee recommends a provision that would extend by 1 year authority under section 804 of the National Defense Authorization Act for Fiscal Year 2004 (Public Law 108-136) to allow the Department of Defense to settle contracts entered into prior to October 1, 1996, under specified conditions.
