SAP & FBO

FedBizOpps was designated, by FAR, as the Governmentwide Point of Entry (GPE). For one thing, this replaced the CBD.

FAR 13.105 states that the CO must display and synopsize requirements unless:

"...(i)FACNET is used for an acquisition at or below the simplified acquisition; or (ii) the GPE is used at or below the simplified acquisition threshold...and offerors are provided a means of responding to the solicitation electronically..."

Does this mean that for actions between $25,001 and $100,000,I must first synopsize and then later post my solicitation in FedBizOpps or can I just post the solicitation since I am providing offerors a means of responding to the solicitation electronically?

Is there value in the synopsis step if I can just post the solicitation and allow a reasonable time for response? Plus, this seems to comply with the regulations.

Synopsis step seems only appropriate for non-competitive actions, and for actions above the SAP.

What am I missing?

You must synopsize at the 25K and up level...you post below that level.

FAR 5.101 speaks to Methods of Disseminating Information.

FAR 5.2 addresses Synopses of Proposed Contracting Actions.

FAR 5.202(e)(13) states the following exception to synopsis:

(13) The proposed contract action--

(i) Is for an amount not expected to exceed the simplified acquisition threshold;

(ii) Will be made through a means that provides access to the notice of proposed contract action through the GPE; and

(iii) Permits the public to respond to the solicitation electronically;

I interpret that exception to mean that if 1) your proposed contracting action doesn't exceed the SAP; and 2)you have posted your proposed contracting action at FBO; and 3) companies can respond electronically to your requirement, then a synopsis is not required.

I believe that once FBO is fully examined, the FAR will be changed to streamline the advertising. I think we should just place the RFP/RFQ/etc directly on FBO and give enough time to make the proposal. This can be easily done for anything above $10K. Why differentiate between post and synopsize. Many agencies are already doing this and cutting response times to 10 days or less on simple things as well. Just look at some of the postings. Right or wrong the pressure is on to change outdated regs.

My interpretation is the same as Linda Koone's (she laid it out much better) but would Anonymous 1/29 and Dave Barnett agree that there is an exception?

Anonymous of 1/30 is probably accurate - regs are outdated, not keeping up with technology.

I'll agree there are exceptions, my previous post was general in nature. Unless specifics are provided how can one address the question in other than general terms?

I have always assumed that posting to FBO was the "synopsis".
