SEC. 813. AMENDMENT RELATING TO COMPELLING REASONS FOR WAIVING SUSPENSION OR DEBARMENT. Section 2393(b) of title 10, United States Code, is amended in the second sentence by striking `in a file available for public inspection' and inserting `on a publicly accessible website to the maximum extent practicable'.

Amendment relating to compelling
reasons for waiving suspension or debarment (sec. 813)
The House bill contained a provision (sec. 815) that would amend section 2393(b) of title 10, United States Code, by requiring the Secretary of Defense to make available on a publicly accessible website any determination that there is a compelling reason to solicit an offer from, award a contract to, extend a contract with, or approve a subcontract with an offeror or contractor that has been debarred or suspended by a federal agency. The Senate committee-reported bill contained no similar provision. The agreement contains the provision with a technical amendment.
