SEC. 814. IMPROVEMENT IN DEFENSE DESIGN-BUILD CONSTRUCTION PROCESS. Section 2305a of title 10, United States Code, is amended by striking the second sentence of subsection (d) and inserting the following: `If the contract value exceeds $4,000,000, the maximum number specified in the solicitation shall not exceed 5 unless the head of the contracting activity, delegable to a level no lower than the senior contracting official within the contracting activity, approves the contracting officer's justification with respect to an individual solicitation that a number greater than 5 is in the Federal Government's interest. The contracting officer shall provide written documentation of how a maximum number exceeding 5 is consistent with the purposes and objectives of the two-phase selection procedures.'. |
Improvement in defense design-build
construction process (sec. 814)
The House bill contained a provision (sec. 805) that would amend section 3309 of title 41, United States Code, and section 2305a of title 10, United States Code, by limiting the maximum number specified in the solicitation for a design-build contract. Additionally, this provision would require the head of an agency awarding a contract pursuant to this provision to provide a report to the Director of the Office of Management and Budget. The Senate committee-reported bill contained no similar provision. The agreement includes the House provision with an amendment that would limit application of the provision to section 2305a of title 10, United States Code, and, for contracts greater than $4.0 million, limit the maximum number of offerors specified in the solicitation for a two-phase design-build contract, unless a higher number is approved by the head of a contracting activity. |
