SEC. 814. Procurement of supplies for
experimental purposes. (a) Additional procurement authority.—Subsection (a) of section 2373 of title 10, United States Code, is amended by inserting “transportation, energy, medical, space-flight,” before “and aeronautical supplies”. (b) Applicability of chapter 137 of title 10, United States Code.—Subsection (b) of such section is amended by striking “only when such purchases are made in quantity” and inserting “only when such purchases are made in quantities greater than necessary for experimentation, technical evaluation, assessment of operational utility, or safety or to provide a residual operational capability”. |
Procurement of supplies for experimental
purposes (sec. 814) The Senate amendment contained a provision (sec. 826) that would update the experimental acquisition authority in section 2373 of title 10, United States Code, to apply to transportation, energy, medical, and space flight and to clarify when provisions of Chapter 137 of title 10 apply to such procurements. The House bill contained no similar provision. The House recedes. Senate Report 114-49 to accompany S. 1376 as it was reported out of the Senate Armed Services Committee. Procurement of supplies for experimental purposes (sec. 826) The committee recommends a provision that would update the experimental acquisition authority in section 2373 of title 10, United States Code, to apply to transportation, energy, medical, and space flight and to clarify when provisions of Chapter 137 of title 10 apply to such procurements. The committee believes that the authorities of section 2373 (in addition to other transaction authority in section 2371 and section 845 other transaction prototype authority) offer an alternative acquisition path for the Department of Defense to pursue technologies and solutions from non-traditional contractors to maintain technological superiority in the future. |
