SEC. 805. CONGRESSIONAL NOTIFICATION OF TERMINATION OF A MIDDLE TIER
ACQUISITION PROGRAM.


Section 804 of the National Defense Authorization Act for Fiscal Year 2016 (10 U.S.C. 2302 note) is amended by adding at the end the following new subsection:

``(e) Report.--Not later than 30 days after the date of termination of an acquisition program commenced using the authority under this section, the Secretary of Defense shall submit to Congress a notification of such termination. Such notice shall include--

``(1) the initial amount of a contract awarded under such acquisition program;

``(2) the aggregate amount of funds awarded under such contract; and

``(3) written documentation of the reason for termination of such acquisition program.''.

Congressional notification of termination of a middle tier acquisition program (sec. 805)

The House bill contained a provision (sec. 801) that would modify section 804 of the National Defense Authorization Act for Fiscal Year 2016 (Public Law 114-92; 10 U.S.C. 2302 note) to direct the Secretary of Defense to provide notification to the congressional defense committees 30 days after a program is terminated that used the `middle tier' of acquisition authority.

The Senate amendment contained no similar provision.

The Senate recedes.

Section 801--Congressional Notification of Termination of a Middle Tier Acquisition Program

This section would modify section 804 of the National Defense Authorization Act for Fiscal Year 2016 (2302 note of title 10, United States Code) to direct the Secretary of Defense to provide notification to the congressional defense committees 30 days after a program is terminated that used the ``middle tier'' of acquisition authority.
