Revision to requirement to use firm
fixed-price contracts for foreign military sales (sec. 888) The House bill contained a provision (sec. 843) that would amend section 830 of the National Defense Authorization Act for Fiscal Year 2017 (Public Law 114-328) to exclude modifications to a defense service or article requiring significant development work from the requirement to use firm fixed price contracts for foreign military sales. The provision would also prohibit the Secretary of Defense from delegating the authority to waive such requirement below the level of the Service Acquisition Executive. The Senate amendment contained no similar provision. The Senate recedes with an amendment that would repeal section 830 of the National Defense Authorization Act for Fiscal Year 2017.
