SEC. 823. FIVE-YEAR EXTENSION OF AUTHORITY TO CARRY OUT CERTAIN PROTOTYPE PROJECTS.

    Section 845(i) of the National Defense Authorization Act for Fiscal Year 1994 (10 U.S.C. 2371 note) is amended by striking `September 30, 2008' and inserting `September 30, 2013'.

Five-year extension of authority to carry out certain prototype projects (sec. 823)

The House bill contained a provision (sec. 816) that would extend for 5 years the authority of the Secretary of Defense to carry out certain prototype projects.

The Senate amendment contained an identical provision (sec. 825). The conference agreement includes this provision.

SECTION 816--EXTENSION OF AUTHORITY TO CARRY OUT CERTAIN PROTOTYPE PROJECTS

This section would extend the time frame in which the Secretary of Defense and the Secretary of each military department may enter into `Other Transactions' in carrying out certain prototype R&D projects. The authority under this section is extended until September 30, 2013.

The committee recommends a provision that would extend for 5 years the authority to carry out transactions other than contracts and grants in accordance with section 845 of the National Defense Authorization Act for Fiscal Year 1994 (Public Law 103-160).
