The Court, in an opinion for the
Court, said that the Appeals Court erred in saying the issue was
moot. The Court noted that the Department of Transportation had not
approved the Colorado Department of Transportation's procedure for
certifying DBEs. Since
Colorado's procedure was not approved, the DBE certification of
Adarand was not valid. Additionally,
the Court said that it must be clear that the allegedly wrongful
behavior of the government will not recur.
The Court reversed the judgment of the Appeals Court and
sent it back to that Court for further proceedings. |
